Synagein operates www.synagein.com and associated subdomains,Synagein mobile application, any software embedded within the Synagein app, aswell as any features, content, websites (or other linked pages) or applicationsoffered, from time to time, by Synagein in connection therewith (collectively,the “Services”). This Privacy Policy covers our treatment of the Personal Datathat we collect when you access or use the Services.  It does not coverthe practices of companies that we do not own or control, or people that we donot manage. We are not responsible for the policies and practices of any thirdparties, and we do not control, operate, or endorse any information, products,or services that may be offered by third parties or accessible on or throughthe Services.
By using or accessing the Services in any manner, youacknowledge that you accept the practices and policies outlined in this PrivacyPolicy, and you hereby consent to the collection, use, and disclosure of yourinformation as set out in this Privacy Policy.
ADDITIONAL TERMS
Your use of the Services is at all times subject to our separate Terms of Use or such other customer or user agreement between Synagein and the entity through which you access and use the Services, which incorporates this PrivacyPolicy. Any terms we use in this Privacy Policy without defining them have thedefinitions given to them in our Terms of Use.

CHANGES TO THIS PRIVACY POLICY
We’reconstantly trying to improve our Services, so we may need to change thisPrivacy Policy from time to time, but we will alert you to changes by placing anotice on the Synagein website, by sending you an email, and/or by some othermeans. Please note that if you’ve opted not to receive legal notice emails fromus (or you haven’t provided us with your email address), those legal noticeswill still govern your use of the Services, and you are still responsible forreading and understanding them. If you use the Services after any changes tothe Privacy Policy have been posted, that means you agree to all of thechanges. Use of information we collect is subject to the Privacy Policy ineffect at the time such information is collected.

TRANSFERS OF PERSONAL DATAT
heServices are hosted and operated in the United States (“U.S.”) through Synageinand our service providers. If you do not reside in the U.S., laws in the U.S.may differ from the laws where you are located. By using the Services, youacknowledge that Personal Data about you, regardless of whether provided by youor obtained from a third party, is being provided to Synagein in the U.S. andwill be hosted on U.S. servers, and you authorize Synagein to transfer, store,and process your information to and in the U.S., and possibly other countries.You hereby consent to the transfer of your data to the U.S. as set forthherein.

PERSONALDATA OF EU RESIDENTS
If youare a resident of the European Union (“EU”), United Kingdom, Lichtenstein,Norway, or Iceland, you may have additional rights under the EU General DataProtection Regulation (the “GDPR”) with respect to your Personal Data, asfurther described in the “Privacy Notice for EU Residents” section below.

PERSONALDATA OF CHILDREN
We donot knowingly collect or solicit Personal Data from anyone under the age of 18,or under the age of 16 in countries subject to the GDPR, unless exempted byindividual country exceptions (for more information, please see “Privacy Noticefor EU Residents” below). If you are under 18, or 16 where applicable, pleasedo not attempt to register for the Services or send any Personal Data aboutyourself to us. HOW WE SHARE YOUR PERSONAL DATADisclosures of Personal Data for a Business PurposeWe disclose your Personal Data to service providers and other parties for the following business purposes:

Our Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide our Services to you and to operate and improve our Services. For example, our agents may process data, analyze usage patterns, or perform other types of analysis and evaluation on our behalf. Synagein uses a payment processing company to receive and process your credit card transactions for us. Unless we tell you differently, our agents do not have any right to use the Personal Data we share with them beyond what is necessary to assist us.
Protection of Synagein and Others: We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Synagein, our employees, our users, or others.

HOW WE USE AND SHARE INFORMATION THAT IS NOT PERSONAL DATA
We may use information that is not Personal Data, including Personal Data that hasbeen aggregated or de-identified in a manner that no longer identifies you asan individual, for informational purposes, analytics or our own internalresearch purposes. We may also use such information to improve and customizeour Services. We may disclose such information publicly and to third parties,for example, in reports we may publish about exercise and activity or otherrelated research, and to partners under agreement with Synagein. We may alsoprovide aggregate usage information to our partners, who may use such information to understand how often and in what ways people use our Services,so that they, too, can provide you with an optimal online experience. Our advertising partners may use such information to display ads which they believe are more relevant to you. However, we do not disclose aggregate information to a partnerin a manner that would identify you personally, as an individual, and we use technical measures and safeguards to help ensure that partners do not attemptto re-identify such information.
DATASECURITY AND RETENTION OF PERSONAL DATA
We seek to protect your Personal Data from unauthorized access, use and disclosureusing appropriate physical, technical, organizational and administrativesecurity measures based on the type of Personal Data and how we are processingthat data. AggregatedData
Aggregated Data means data that has undergone a processwhereby raw data is gathered and expressed in a summary form for statisticalanalysis. Raw data can be aggregated over a given time period, acrossindividuals, or both, to provide statistics such as average, minimum, maximum,sum, and count. After the data is aggregated, analysis can be performed to gaininsights about particular data sets. When data is aggregated across a number ofindividuals, the resulting aggregation is considered anonymized such that itcan no longer be associated with a specific individual. 

CCPA
The California Consumer Privacy Act, or CCPA, is a statelaw that provides California consumers with robust data privacy rights. Theserights include the right to know, the right to delete, the right to opt-out of“sale” of personal information that businesses collect and additionalprotections for minors. A “sale” under the CCPA is defined as: “selling,renting, releasing, disclosing, disseminating, making available, transferring,or otherwise communicating orally, in writing, or by electronic or other means,a consumer’s personal information by the business to another business or athird party for monetary or other valuable consideration.”

 Cookies
Cookies are small files which are stored on a user’scomputer. They are designed to hold a modest amount of data specific to aparticular client and website, and can be accessed either by the web server orthe client computer. This allows the server to deliver a page tailored to aparticular user, or the page itself can contain some script which is aware ofthe data in the cookie and so is able to carry information from one visit tothe website (or related site) to the next. 

De-IdentifiedData
De-Identified Data means data where all the personallyidentifiable information has been removed and is rendered anonymous bystripping out information that would allow an individual’s identity to bedetermined from the remaining data. Data is “de-identified” to protect theprivacy and identity of individuals associated with the data and“de-identification” is often part of a process used to make sure the datasubjects remain anonymous.

“DoNot Sell My Personal Information”
The CCPA (California Consumer Privacy Act – see definitionabove) requires certain businesses to post this language as a link in aconspicuous place on their website. The purpose of this link is to provide amethod for a California consumer to opt-out of the “sale” of their “personalinformation” (each as defined under the CCPA). GDPR

An IP address is a unique address that identifies a deviceon the Internet or a local network. It allows a system to be recognized byother systems connected via the Internet protocol. An IP Address may beconsidered “Personal Data” and is at times used by advertisers to serveinterest-based ads.

Personal Data means any information that identifies orrelates to you as a particular individual, including information referred to as“personally identifiable information” or “personal information” underapplicable data privacy laws, rules, or regulations.

The Services means, collectively, www.synageinfitness.com,associated subdomains, the Synagein mobile application, as well as anyfeatures, content, websites (or other linked pages) or applications offered,from time to time, by Synagein in connection therewith.

ThirdParties
Third Parties in the context of the relationship betweenSynagein, Synagein Members (our end users), and third parties are entities orbusinesses involved in an arrangement, contract, deal, or transaction but arenot one of the principals (i.e.,. Synagein or Synagein Members). We use ThirdParties to enable us to do business with our members, such as charging fortransactions or storing data. Third Parties also include advertisers that serveinterest-based ads to visitors to our website.
